1. General
(a) By engaging Manny’s Many Services (the “Service Provider”), the Client acknowledges and agrees to be bound by these Terms and Conditions.
(b) These Terms and Conditions constitute the entire agreement between the parties in relation to the provision of cleaning, lawn mowing, and gardening services, and supersede any prior agreements, representations, or understandings whether written or oral.
(c) The Service Provider agrees to perform the services in a professional manner and in compliance with applicable Australian laws and regulations.
2. Services Provided
(a) The services to be provided by the Service Provider include:
(i) Commercial Cleaning: indoor and outdoor cleaning, ground-level window and glass cleaning (inside and outside), driveway/path cleaning (blower use; pressure washing available by separate quotation), and general property maintenance. High-access or elevated window cleaning is not provided.
(ii) Lawn Mowing & Gardening: lawn mowing, edging, hedge trimming, pruning, weeding, fertilising, raking, blowing, and general yard maintenance.
(iii) Additional Services: mulching, planting, rubbish removal, seasonal clean-ups, or other garden care requests, which must be agreed in writing and are subject to separate quotation.
(b) Any service not expressly included under clause 2(a) will be deemed additional work and will not be carried out unless separately agreed in writing.
2.1 Minimum Service Hours
(a) The Service Provider requires a minimum of two (2) hours per booking.
(b) This policy reflects the increasing costs of travel, fuel, and materials.
(c) Bookings shorter than two (2) hours will still be invoiced at the minimum service rate.
3. Client Responsibilities
(a) The Client must:
(i) provide safe and timely access to the property;
(ii) ensure pets, valuables, and fragile items are secured; and
(iii) inform the Service Provider of any hazards or restricted areas.
(b) If the Client fails to comply, the Service Provider shall not be liable for delays, loss, or damage arising as a consequence.
4. Health, Safety & Legal Compliance
(a) The Service Provider complies with all applicable Work Health & Safety laws.
(b) All equipment, products, and chemicals used are industry-approved.
(c) The Client warrants that the premises are reasonably free from dangerous conditions.
5. Payment
(a) All invoices are payable within seven (7) days unless otherwise agreed.
(b) Interest accrues on overdue invoices at five percent (5%) per month, compounding monthly.
(c) The Client is liable for recovery costs including debt collection and legal fees.
(d) Quotations remain valid for fourteen (14) days unless otherwise stated.
(e) Payments are to be made to the nominated account of Manny’s Many Services.
5.1 Payment Arrangements
(a) All payments are to be made by the Client into the nominated account of Manny’s Many Services within seven (7) days of the invoice date.
(b) Bank account details will be provided on invoice.
(c) The Client must ensure the correct reference is included to avoid delays in processing payments.
(d) Payment may also be accepted by other electronic methods as agreed in writing (e.g., bank transfer, direct deposit, or PayID if available).
(e) Failure to pay in accordance with these arrangements may result in suspension of services until payment is received.
6. Cancellations
(a) The Client must provide a minimum of forty-eight (48) hours’ written notice to cancel or reschedule.
(b) Less than 48 hours’ notice = 50% of service fee.
(c) Same-day cancellation = up to 100% of service fee.
7. Call-out Fee
A separate Call-out Fee applies to cover travel and time if no work is carried out. The fee is $75 for local area jobs, $80 for medium distance (20–30 minutes travel), and $100 for longer travel (30–45 minutes+).
8. Liability
(a) The Service Provider maintains business insurance, including Public Liability.
(b) The Service Provider is not liable for:
(i) Pre-existing damage;
(ii) Reasonable wear and tear;
(iii) Loss/damage caused by Client negligence or unsafe conditions.
9. Satisfaction Guarantee
(a) The Client must notify in writing within 24 hours if dissatisfied.
(b) The Service Provider will be given reasonable opportunity to rectify.
10. Termination
(a) Either party may terminate by providing 14 days’ written notice.
(b) The Service Provider may terminate immediately for safety concerns, abusive conduct, or payment breaches.
11. Governing Law
These Terms and Conditions shall be governed by the laws of New South Wales, Australia. The parties submit to the exclusive jurisdiction of the courts of New South Wales.
12. Force Majeure
The Service Provider shall not be liable for delay or failure to perform if caused by events beyond its control, including weather, illness, disasters, strikes, or government restrictions.
13. Changes to Services
Any variations or changes must be confirmed in writing and may result in additional charges.
14. Non-refundable Deposits
For commercial or large-scale contracts, a non-refundable deposit of 10–20% may be required to secure booking.
15. Insurance
The Service Provider maintains business insurance, including Public Liability Insurance. Policy details may be provided upon request.
16. Acceptance
(a) The Client acknowledges they have read and understood these Terms and Conditions.
(b) By signing the forms issued by Manny Many Services, the Client accepts these Terms and Conditions and agrees to be bound.
(c) This agreement takes effect upon signing and remains until terminated in accordance with clause 10.
